General Terms and Conditions


  1. Definitions

1.1 In these General Terms and Conditions, the following terms have the following meanings:

  • General Terms and Conditions: the General Terms and Conditions of Floating Amsterdam
  •  Ticket: a document of access to an event
    •    Event: a public or private event at which an activity of a guest takes place.
    •    Location: the place where the event takes place
    •    Agreement: the agreement between Floating Amsterdam and the consumer of purchase, sale and delivery of tickets and/or rental, payment and delivery of a boat.

    2. Applicability

2.1 The General Terms and Conditions below and the booking and ordering conditions of Floating Amsterdam apply to all offers, orders and agreements of Floating Amsterdam.
2.2 The consumer expressly accepts the applicability of these General Terms and Conditions by accepting an offer or making an order.
2.3 Deviations from that stipulated in these Terms and Conditions are only possible in writing, in which case the other provisions will remain undiminished in force.

  1. Payments

Floating Amsterdam accepts several different payment methods. Payments in euros are processed via iDEAL, by credit card or cash. You will not receive confirmation of your definitive booking until your payment has been approved.

4. Prices and offers

4.1 All offers made by Floating Amsterdam are without obligation and Floating Amsterdam expressly reserves the right to change the prices and/or locations.
4.2 In certain cases, promotional prices apply and are valid during a specific period as long as stocks last. No entitlement to these prices may be invoked before or after the specific period.

4.3 All prices are indicated in euros.

4.4 Floating Amsterdam cannot be held to any price indications that are clearly incorrect, for example as a result of obvious typesetting or printing errors. No rights may be derived from incorrect price information.

  1. Returns/cancellations

5.1 No refunds will be made on pre-purchased tickets, exceptions to be discussed with management. This is also the case if the admission ticket is only valid for a certain time and/or date.
5.2 An organizer is entitled to cancel or change the date of an event. In this case, Floating Amsterdam will attempt to provide a suitable solution. If an event is cancelled or postponed, Floating Amsterdam will do its utmost to inform you as soon as possible. However, Floating Amsterdam cannot guarantee it is possible to inform you timely of any change or cancellation of an event or be held responsible for refunds, compensations or for any resulting costs you may incur, for example for travel, accommodation and/or any other related goods or service.
5.3 Floating Amsterdam will not be liable for damage, misuse or loss of tickets. No duplicate tickets will be issued to replace tickets that have been misused, mistreated, lost or stolen nor will such tickets be refunded.
5.4 Floating Amsterdam will not be liable for delays, non-delivery or incorrect delivery of tickets.

  1. Delivery

6.1 Tickets will be delivered to the e-mail address included in Floating Amsterdam’s  address database.

7. Retention of title
7.1 The ownership of the tickets delivered will only transfer to you if you have met all your obligations to Floating Amsterdam pursuant to any agreement whatsoever. The risk relating to the tickets will be transferred to you at the time of delivery.

  1. Complaints and liability

8.1 You are obliged to check on delivery to ensure that the tickets are in line with the agreement. If this is not the case, you must inform Floating Amsterdam in writing and with reasons as soon as possible and at all events within three (3) days of delivery, providing that it was reasonably possible to ascertain this fact.
8.2 If it has been demonstrated that the tickets are not in line with the agreement, Floating Amsterdam may choose to replace the tickets in question with new tickets in exchange for their return or to refund the amount paid.

  1. Electronic communication and evidence

9.1 Floating Amsterdam is not liable for any misunderstandings, distortions, delays or incorrect transmission of data and messages as a result of the use of the internet or any other communication resource in the traffic between the customer and Floating Amsterdam (or the parties deployed by the customer).
9.2 All documents and reports from Floating Amsterdam serve as full proof of the content and implementation of the agreement with the customer. Provided counter-proven by the party that relies on the fact that the evidence is unreliable.

  1. Force majeure

10.1 Floating Amsterdam reserves the right, in case of force majeure at its own discretion, to suspend the execution of your order or to dissolve the agreement without judicial intervention. This will happen by informing you in writing and without Floating Amsterdam being held liable for any compensation, unless this would be unacceptable in the prevailing circumstances in accordance with all reasonableness and fairness.
10.2 By force majeure we mean any shortcoming that cannot be attributed to Floating Amsterdam, because this cannot be attributed to it or its responsibility can be seen in accordance with the law, legal action or generally accepted insights.

  1. Special provisions, liability

11.1. The purchaser of a ticket supplied by Floating Amsterdam must behave as a good and orderly visitor of events and must abide by the instructions issued to him or her by or on behalf of the organizer of the event to be visited as well as by the competent authorities.
11.2 The purchaser of a ticket attends an event at his or her own risk. Floating Amsterdam will not be liable for any damage incurred by the purchaser during the journey to from the event or while attending the event.
11.3 Floating Amsterdam will not be liable for any refusal by the organizer of an event or by the public authorities to admit the purchaser of a ticket supplied by Floating Amsterdam to an event as a result of actions and/or negligence on the part of the purchaser.
11.4 The purchaser of a ticket supplied by Floating Amsterdam must inform him/herself of the instructions issued by or on behalf of the organizer of the event or the competent authorities relating to it, including any changes concerning the event, such as starting time, etc. Floating Amsterdam has no obligation to provide the purchaser of a ticket with further information in this regard.
11.5 Visitors on our boats must behave properly and pay respect and attention to all our properties.

  1. Other provisions

12.1 If one or more of the provisions in these Terms and Conditions or any other agreement with Floating Amsterdam is in conflict with any applicable legal regulation, the provision in question will lapse and be replaced by a new comparable stipulation admissible by law to be determined by Floating Amsterdam.

12.2 The Dutch law applies to all agreements entered into with or concluded by Floating Amsterdam. Any disputes arising directly or indirectly from these agreements will be exclusively settled by the Court of Amsterdam.
